Questions on International Registration of a trademark
Our company is located in a country which not a member of Madrid protocol. As the applicant must first have a national basic mark in the member of Madrid protocol. Can we use a European country (or other member country) as basic filing country?

From shima, 7/13/11 10:35 AM Responsible for international trademark registrations through the Madrid System is the WIPO in Geneva. Registration requests must be made through the trademark office in the home country were the base trademark is registered. Registrations take aout a month. The designated countries have between 12 and 18 months to reject the applications.
Our company wants to register a trademark in several countries at the same time. We haven't registration in any country. Is it possible? Or at first we should register in one country, and only after that make international registration?
From IGOR, 7/18/11 8:03 AMAn international registration requires at least a trademark application in a home country were the company has a business address. Based on this application or registration an international application can be made.
Our company has registered 2 classes in Australia and we were wanting to register 3 classes in the US and possibly other countries what is the process and how long will it take. Can we be assured we will get the trademarks??

The time until the trademark is registered depends on the country in which the application has been made. In the US it takes 4 - 6 months.
It cannot be assured that your trademark will be registered. This depends on several factors like already registered older trademarks which are identical or similar with your trademark, if your sign is merely descriptive for the goods and services etc. You can request a trademark search report which gives you an overview about the registrability.

We have a registered trade mark in India. Now, we want to register some other brand in Germany. Please let us know can we register our new trade mark/ brand in Germany and use in other countries.

An international trademark registration is a special application which requires a basis trademark in one of the member states of the Madrid Agreement / Protocol to the Madrid Agreement. India is not a ember country.
