OAPI Trademark Registration

The African Intellectual Property Organisation, better known by its French acronym “OAPI” has its headquarters in Yaoundé – Cameroon. Its 16 member States include:

The Republic of Benin, Burkina Faso, The Republic of Cameroon, The Central African Republic, The Republic of Chad, The Republic of Congo, The Republic of Cote d’Ivoire, The Republic of Gabon, The Republic of Guinea – Conakry, The Republic of Guinea – Bissau, The Republic of Mali, The Islamic Republic of Mauritania, The Republic of Niger, The Republic of Senegal, The Republic of Togo, Equatorial Guinea.

It should be noted that any Trademark registration in OAPI has an effect (is covered and protected) on all the 16 member States. The issuance of the Certificate of Registration follows about six months after application, depending on the volume of work at OAPI.

A Power of Attorney is required (simply signed, notarisation not required). However, the name and capacity of the signatory as well as the date and place of signature must be indicated. Note that the Power of Attorney must be specific and distinct. This means that one Power of Attorney cannot be used for more than one application. It must mention the particular mark to be filed.

Collective Trademark Application: The above information applies for the registration of collective marks, but for the following additions: The Applicant must tender approved rules for the use of the mark. These rules must contain the modalities of the use of the mark and sanctions for improper use by the members of the collectivity. Foreign collective mark applicants i.e. applicants out of the OAPI region must tender proof of an initial registration in their country of origin.
