INTERNATIONAL TRADEMARK REGISTRATION PROCESS, THROUGH THE MADRID SYSTEM
The Madrid system is an international procedural mechanism, which offers a trademark owner the possibility to have his trademark protected in several countries by simply filing one application directly with the Office where the trademark was originally registered. This allows the extension of the registered trademark to diverse countries, based on a single Trademark Application or Trademark Registration in the Office of Origin.
If the trademark office of a designated country, towards which extension is pretended, grants the registration, the protection of the mark is the same as if it had been registered by that Office. The Madrid system also simplifies greatly the subsequent management of the mark, since it is possible to record subsequent changes or to renew the registration through a single procedural step. Further countries may be designated subsequently. Likewise, through this procedure the registration expenses are considerably reduced, in relation to a country by country direct registration.

From Agus Irawan at 5/17/11 6:22 AM Our company is located in a country which not a member of Madrid protocol. As the applicant must first have a national basic mark in the member of Madrid protocol. Can we use a European country (or other member country) as basic filing country?

This would only be possible if your company has a permanent branch office in one of the EU member states. If there is no connection with the basis country you cannot file an international registration.

Responsible for international trademark registrations through the Madrid System is the WIPO in Geneva. Registration requests must be made through the trademark office in the home country were the base trademark is registered. Registrations take aout a month. The designated countries have between 12 and 18 months to reject the applications.
From IGOR at 7/18/11 8:03 AM Our company wants to register a trademark in several countries at the same time. We haven't registration in any country. Is it possible? Or at first we should register in one country, and only after that make international registration?

An international registration requires at least a trademark application in a home country were the company has a business address. Based on this application or registration an international application can be made.
From Paul Fisher at 8/15/11 1:07 AM Our company has registered 2 classes in Australia and we were wanting to register 3 classes in the US and possibly other countries what is the process and how long will it take. Can we be assured we will get the trademarks??

Please use select the respective countries in which the trademark should be protected here and submit the form for the trademark application:
The time until the trademark is registered depends on the country in which the application has been made. In the US it takes 4 - 6 months.
It cannot be assured that your trademark will be registered. This depends on several factors like already registered older trademarks which are identical or similar with your trademark, if your sign is merely descriptive for the goods and services etc. You can request a trademark search report which gives you an overview about the registrability.

Please use the form to engage us with a national trademark registration in Germany. An international trademark registration is a special application which requires a basis trademark in one of the member states of the Madrid Agreement / Protocol to the Madrid Agreement. India is not a ember country.
