Trade Mark Registration in Paraguay
The Trademark Registration procedure begins with the Application presented before the Industrial Property Office. This application has to go through an exam in order to see if all documents required by law were included in the application. After this examination procedure, the application is published for a period of three consecutive days. A period of sixty days in order to file oppositions against the application follows the last publication day. After the opposition period, and if no opposition is filed, the application has to go through another exam, in order to verify whether the application is similar to previous Trademark Registrations or not. In the event that similar Registrations exist, and if the similarities are to harm the rights of the owners of these Registrations, the application can either be rejected or have its coverage limited to specific products. If no records of similar Trademark Registrations are found, the Director of the Industrial Property Office shall grant the Registration to the application at hand. Please consider that this procedure takes normally between six to eight months.
